Defects of Consent Essay A defect of consent is a situation where a party’s declaration does not reflect his actual intent. This difference between declaration and intent may be caused by other parties,in order to make someone to form a contract with themselves. Fraud and Duress are this kind of defects. Roughly,fraud is deceiving someone by hiding certain facts or giving them a wrong impression/information in order to make them form a contract and duress is scaring or threatening someone to make them form a contract. If there is a difference between declaration and intent,which unintentionally resulted from the declarant,we can say there is an error. In some cases,both parties are mistaken about contract. Such defects are called â€Å"Collective Error†. In these situations,contract is formed by parties’ true intent,not according to their false statements. Error In the TCO article 30,the law states that â€Å"A party acting under an essential error when entering into a contract is not bound by it. † Interpreting this article,we can deduce that essentiality is a key concept,since unessential errors will not affect validity of the contract. Some aspects of essential error are specified in TCO,but law does not limit cases of essential error with those articles. Unwritten states of essential error are determined by the rules of good faith. Error may occur in several ways: Error in declaration In the TCO article 31 the law sets forth: An error is deemed particularly essential in the following cases 1-Where a party intended to conclude a contract different from that to which he consented. On the other hand,if the other party does not know or have to know the signer’s intent,contract will be formed,but signing party by proving that the error is essential,can benefit from provisions of error in declaration. Error in Motive Error in motive is caused by an error in the formation of intent. On principle,error in motive is not essential. If there are conditions prescribed by the law,there is an essential error in motive. In TCO article 32,the law sets forth that â€Å"Error in motive is not deemed as essential unless the mistaken party deems the motive as necessary basis for the contract and it is valid regarding the business affairs in good faith. Yet this rule is not applicable unless the other party is aware of this motive† According to this article,error in motive is essential if the party deems this motive as necessary basis for the contact. This means the party is mistaken about a subject or qualifications of someone which affected his decision to form the contract. Error in material qualification,error in fact,error in legal status are examples of such mistakes. A wants to buy sculpor B’s statue but in fact the statue is a replica. In this situation there is error in material qualification. A thinks he is assigned to a job in another city,so he rents a house in that city. He made an error in fact. A purchases a land to build a house,but does not know construction is forbidden on this site. He is mistaken about land’s legal status. Also if other party is or has to be aware of the motive,error is deemed as essential. This should be determined in the present case. Avoidability In TCO art. 30 the law stipulates that â€Å"A party acting under an essential error when entering into a contract is not bound by it. † However this is limited by TCO art. 39. The contract will be valid if the mistaken party does not abolish the contract in a year,beginning from the moment he realises his error. Good Faith Rules in Error Right to avoid is also limited by the law. The law states in TCO art. 34 that â€Å"A person may not advance error in a manner in violation of good faith. In particular, the contract is considered to be concluded in a way that the party acting in error intended, in case the other party declares his consent to be bound by that contract. † Violation of good faith mentioned in the first subsection may be like this: A person learns that he made an essential error about a contract which he concluded years ago. He wants to use his right to avoid just to damage other party. In that case he will not be able to benefit from provisions of error since it is a violation of good faith. Second subsection of this provision is particularly important. In the interests of equity, the Court may, not exceeding the benefit of standart performance, award further damages to the injured party. † The first subsection is about responsibility of parties’ actions before the formation of the contract (culpa in contrahendo). Even a slightest negligence in error results in culpa in contrahendo,and in such situations damages will be compensated. According to the second sentence of this subsection,there will not be any compensations if the other party knew or should have known of the error. But this provision is not applicable to error of declaration,since if the other party knew or should have known the error in declaration,contract is formed according to the declarant’s real intent. Yet if a party knows or has to know other party made an error in motive,mistaken party will not have to compensate any damages even if he abolishes the contract. Amount of the damage that will be compensated,is the damage that would not exist if the contract would not be formed. This kind of damage is â€Å"negative damage†. Benefit of the standart performance is named as â€Å"positive damage†. According to the second subsection,judge may decide further damages. This â€Å"further damage† is compensation of positive damage. Amount of positive damage that must be compensated may be some of the positive damage or all of the positive damage,determined by equity,but cannot exceed positive damage.

A crisis caused the development of the PA profession. This problem was the widely held belief that there was a shortage of medically trained personnel , which originated from the 1959 Report of the Surgeon General’s Consultant Group of Medical Education. This report gave three main reasons why an expansion of health care was needed in the United States: 1. There was fear of rapid population growth projections with disproportionate increases of the young and elderly. These two populations statistically and historically utilize more health care than the average populace. 2. There was an increased per capita use of health care facilities. This was spurred by numerous factors. The first was improved living standards that brought higher life expectancy and lower infant mortality.

The Greeks and gods Essay

The Greeks looked at their gods with attributes they only wished they could attain. They developed stories of extraordinary people that were the offspring of immortals such as Nymphs or gods like Hermes or Zeus. Most of these stories consisted of labors, quests, or bloody wars, where the heroes were at the epicenter of the tale. What made these heroes so great was not just the fact they had godly attributes or completed monumental tasks, but endured more tragedy or more bliss than any common Greek would undergo. One tale commonly told was that of a demigod named Achilles. His mother Thetis was a Sea Nymph, and his father was Peleus, was the king of the Myrmidons. Most stories of Achilles revolved around war, where either his gift was at his greatest or worst. Every Greek sought him for battle so his skills would tip the balance to their favor. No myth exemplified this more than that of the ten-year Trojan War. An excerpt from a translation written by Apollodorus that accounts this time state, â€Å"He also took Lesbos and Phocaea, then Colophon, and Smyrna, and Clazomenae, and Cyme; and afterwards Aegialus and Tenos, the so-called Hundred Cities; then, in order, Adramytium and Side; then Endium, and Linaeum, and Colone. He took also Hypoplacian Thebes and Lyrnessus, and further Antandrus, and many other cities. † (Frazer) By many accounts, you could argue that Achilles was the dealer of death and that he relished in every moment of his adventures. By his own words, this was not the case. For example, in the textbook the Classical Mythology it states, â€Å"The now dead Achilles laments, I should prefer as a slave to serve another man, even if he had no property and little to live on, than to rule all those dead who have done with life† (Morford, Lenardon, Sham, 2011). Another hero that many spoke of during that day an age was Odysseus. He was a descendant of Hermes who became king of Ithaca. The real stories of Odysseus that Greeks and many others embrace were of the Trojan War and Homers poem the Odyssey. Some Greeks would argue Odysseus came second only to Achilles as a hero due the trials he endured. Odysseus’s story began at the start of the Trojan War where he stood and fought for ten years. After nine years of failure, Odysseus was enlightened by Athena to trick the Trojans and capture its city. He erected a symbol, he knew only the Trojans would accept and embrace. He hid the strongest Greeks inside a giant wooden horse who laid and waited until nightfall. Once inside impenetrable walls the Greeks were able to sake the city. Once war was all but over, Odysseus  sailed for home. â€Å"Come then, do as I say, let us all be won over; let us run away with our ships to the beloved land of our fathers since no longer now shall we capture Troy of the wide ways. † (Lattimore, 1999) During this voyage, he encountered a man eating Cyclops named Polyphemus who he ended up blinding to escape. Unbeknownst to him Polyphemus was the son of Poseidon, god of the sea, who became enraged. The consequences of these actions did not lead him home to his kingdom and beloved wife, but astray for another ten years of wars and adventures. The one hero that endured more pain and suffering than any other was Heracles. He was the bastard son of the god Zeus and a beautiful Greek woman named Alcmena. Hera, the wife of Zeus, always showed distain for Zeus’s infidelities, yet took a close personal interest in Heracles. There are several instances where she intervened to cause him great tragedy. First, she tried to stop his birth. This was only overcome by tricking Ilithyia, the goddess of birth, who Hera had sent. Months after that Hera sent serpents to his cradle, but he grabbed them by the neck shacking them as if they were just one of his toys. The next obstacle came when he was a man after he was to wed the King Creon’s daughter, Megara. Seeing that Heracles had found his piece of happiness with his new wife and daughters Hera drove Heracles mad. In his fit of rage, he killed them. Overwhelmed with grief Heracles searched for a way of redemption. He came across the King of Tiryns, Eurystheus, who told him the only way he could cleanse his soul was to endure 12 impossible labors. One of his labours was to kill the Nemian lion, which was ironic. â€Å"The Nemeian Lion whom Hera, the queenly wife of Zeus, trained up and settled among the hills of Nemeia, to be a plague to mankind. There he preyed upon the tribes of the indwelling people, and was as a king over Tretos and Apesas and Nemeia. Nevertheless, the force of strong Heracles subdued him† (Evelyn-White, 1914). After completing the 12 labours, Heracles enjoyed many adventures. He saved Olympus from the Gigantes and assisted in conquering Troy. For a moment, life for him was peaceful until Hera drove him mad again. During that fit of rage, he threw his closest friend Iphitus over a wall to his death. After this tragedy, Heracles knew he would have to cleanse his soul again. Queen Omphale offered him a choice. A task that would require him to endure one of the worst shames a man could. Her proposal was for him to wear women’s clothing and conduct the tasks as one of her female servants. For the next three years, Heracles completed his servitude in shame without ever being honored for any of his previous glories. In conclusion, all these heroes had godly attributes which enabled them to complete monumental tasks, but at the same time endure more tragedy or bliss than any common Greek would undergo. Achilles was a great warrior but found no peace with what he had accomplished in his life. Heracles also endured much strife and ended up dying a gruesome fate. On the other hand, Odysseus left his home, endured many obstacles, but returned from twenty years of servitude with rejoices from all of Greece. Perkin Warbeck Essay Explain why Perkin Warbeck remained a threat to the security of Henry VII for so many years. Perkin Warbeck was the second Yorkist pretender to the English throne after Lambert Simnel was defeated at the Battle of Stoke in 1487. Between the years 1491-99, he posed a significantly destabilising threat to Henry VII in dynastic terms, impersonating Richard of York, the younger son of Edward IV. The successes of Warbeck, which led him to remain a threat to the Kings security, may be largely categorised into the support from foreign powers during this period and discontent existing in England due to Henrys methods of ruling with relation to sustaining an authoritative and respected status both within his own country and abroad. Whilst it is possible to challenge such a concept of a threat, Warbeck was eventually executed in November 1499, demonstrating in a modern context that the Kings perception of this pretender was one of great concern for his position. Steven Gunn has suggested that Henry was a usurper and carried with him the problems of this title. Upon taking the English throne, it was inevitable that Henry would face opposition to his rule, particularly in consideration of his lack of familiarity with English politics and those supporters of the Yorkist claim. With the knowledge that Richard III intended John de la Pole to inherit the crown and having already fought at the Battle of Stoke to secure his position, it would seem almost equally likely that Henry would be a paranoid character by the time that Perkin Warbeck came to attention, and he could not predetermine the reactions of the De la Pole family, who were largely responsible for the pretenders. It is significant not only that Warbeck was the second embodiment of discontent within Henrys reign, but also that political unsettlement had been apparent under his predecessor also a usurper. Henry is likely to have feared reaching the same fate as Richard III, whose reign had been plagued with suspicions surrounding the Princes in the Tower controversy and indeed, the dating of his coronation to appear three days before his victory at Bosworth suggests paranoia existing even before his rule. Thus Warbeck is best viewed in one sense as a non-military threat, being an encouragement of this paranoia through the exploitation of Henrys potentially weak position. He reminded the King of the existence of dissatisfaction within his own country and later among foreign powers. The princes had never been seen again and were presumed murdered by their uncle, Richard III. In this way, there was an immediate simplicity for Warbeck to exploit the lack of clarification as to what had happened to them. Whereas Lambert Simnels claim was flawed in that Henry was able to parade the true Earl of Warwick through London during the crisis, Warbeck was imitating Edward IVs younger son, Richard of York. Hence this crisis was much more serious, for Henry was unable to prove the existence of the true Richard and if Warbeck truly was the prince he impersonated, his claim to the English throne would have been superior to that of Henry. The threat of Warbeck was enlarged by the context in which it occurred those behind the pretender were able to follow a potentially fatal method by which Henrys position could be destabilised. In order to ascertain why any pretender to the throne would become a prolonged threat, the nature of the monarchs rule must be evaluated. The view of Steven Gunn could be expanded upon to maintain that Henrys rule naturally had characteristics of that of a usurper: unlike a hereditary monarch, he required more stringent methods of discipline to enforce his position as a ruler. In addition to passing attainders against those involved with the pretenders (Edmund de la Pole was fined à ¯Ã‚ ¿Ã‚ ½5000 to inherit some of his brothers lands and never inherited the dukedom of Suffolk for his involvement with Simnel) Empson and Dudley greatly assisted in coordinating the increased use of bonds and recognisances against subjects. Then in 1497, Perkin Warbecks forces rallied the rebels during the second Cornish Rising in protest against raised taxes to support the invasion of Scotland and together, they nearly took the city of Exeter. In this way, it can be observed that Warbeck becoming a threat was in a paradoxical sense Henry needed to use more powerful methods of rule to secure his own position and dynasty than an ordinary monarch due to his status, though the discontent which such methods brought about led to resentful individuals turning to the diversion of Warbeck. Threats in military terms from Perkin Warbeck during this period may be largely attributed to foreign support. Indeed, Warbeck potentially had concern also from nobility such as Sir William Stanley, as Margaret of Burgundy, sister of Edward IV, proclaimed him as her long-lost nephew. The role of France was crucial in causing Warbeck to remain a threat to the security of Henrys position. In 1491, he moved to the French court and was treated similarly to a prince by Charles VIII, which illustrated to Henry a possibility of an invasion the French had funded his own invasion of England in 1485 to overthrow Richard III, and the case could potentially have been that this claimant was genuine. The threat was heightened by Charles discontent in 1492 after Henrys assistance of the Duchess of Brittany in an attempt to retain her independence from France, whilst the 1489 Treaty of Medina del Campo with Spain led the French to encourage James IV of Scotland to invade England. It was Henrys invasion of France in 1492 which appeared to be a very drastic action with regard to this pretender it was clear that with foreign military backing, his position could be significantly threatened. However, in this respect, it must be noted that the threat was not Warbeck as an individual, but rather the concept of the proceedings and those supporting him. He became a focus for French discontent with Henry VII in the same way that he had been a Yorkist focus in England. A prolonged threat from any pretender to any throne can always be attributed to discontent with a monarchs rule. Conformingly, Perkin Warbeck was often able to exploit this to enlist support and increase opposition to the King. It is clear that the level of foreign support given to the pretender ultimately was the greatest contributing factor in threatening Henrys security due to the possibility of a successful invasion, though the paranoia and the methods of rule enlisted to secure his dynasty were equal factors in causing Warbeck to remain a threat. In contrast, it is very significant that Warbeck was never a primary threat as an individual, but merely a strong secondary threat behind the foreign powers and nobility that supported him it was the concept that destabilised the position of Henry VII.

A Brief History of Unix This document is designed to give people with no previous UNIX experience some sense of what UNIX is. This document will cover the history of UNIX and an introduction to UNIX. HISTORY OF UNIX AND CAUSES FOR ITS POPULARITY Most discussions of UNIX begin with the history of UNIX without explaining why the history of UNIX is important to understanding UNIX. The remainder of this document will describe some strengths and weaknesses of UNIX and attempt to explain why UNIX is becoming popular. All of UNIX's strengths and weaknesses can be directly related to the history of its development, hence a discussion of history is very useful. UNIX was originally developed at Bell Laboratories as a private research project by a small group of people starting in 1969. This group had experience with a number of different operating systems research efforts in the 1970's. The goals of the group were to design an operating system to satisfy the following objectives: Simple and elegant Written in a high level language rather than assembly language Allow re-use of code Typical vendor operating systems of the time were extremely large and all written in assembly language. UNIX had a relatively small amount of code written in assembly language (this is called the kernel) and the remaining code for the operating system was written in a high level language called C. The group worked primarily in the high level language in developing the operating system. As this development continued, small changes were necessary in the kernel and the language to allow the operating system to be completed. Through this evolution the kernel and associated software were extended until a complete operating system was written on top of the kernel in the language C. UNIX APPLICATION PROGRAMMING INTERFACE Many proprietary operating systems have a simplified view of application behavior. The typical application reads some data from disk, tape or a terminal and does some processing. Output is produced onto disk, tape, tape, terminal, or printer. The operating systems generally provide easy to use well-implemented facilities to support these types of facilities. As applications become more sophisticated they need new features such as network access, multi-tasking, and interprocess communications. In traditional operating systems, these features are often hard to use, not well documented, and only callable from assembly language. When a program makes use of these features, the program may be much more complex and much more difficult to maintain. In UNIX because the C language was written to be used to implement an operating system rather than a traditional "input-processing-output" application, use of these sophisticated features is quite easily done from the C language without writing any assembly language.

Heathcliff as Byronic Hero of Wuthering Heights      Ã‚   It is difficult if not impossible to find a character in Emily Bronte's Wuthering Heights that is 100% convincing as the hero -- until one applies the qualities of the Byronic hero.   Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   When considering Wuthering Heights Heathcliff immediately jumps to mind as the villainous character.   Upon his return he wickedly orchestrates Hindley's economic demise and takes control of the Heights.   He attempts to win Catherine, now a married woman, back and when that fails takes in marriage Isabelle Linton, Edgar's sister, with the sole intention of torturing her as a way of avenging himself on Edgar for marrying the woman he loved.   When Hindley died Heathcliff took his son, Hareton, in order to treat him as cruelly as Hindley had treated Heathcliff, thus taking his revenge on Hindley.   To further punish Edgar, Heathcliff kidnaps Cathy, forces her to marry his son, Linton, and in so doing gains possession of Thruschcross Grange and has the authority to treat Cathy as he desires.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Heathcliff obviously has a nasty vengeful side but that makes his character perfect to bear the mantle of the Byronic hero.  Ã‚   He rebels against the social order in his world by attempting to defy Hindley and associate with Catherine and later in his attempt to woo her from Edgar's arms and home and make her his own.   He is very definitely self-destructive and cares for no one but himself and Catherine, which at times seem debatable.   His passion in life is not life but to avenge himself upon everyone that has ever slighted him.   He systematically destroys the lives of the people who hurt him but he refuses to stop there - insisting upon further punishing those individuals through... ...nder the earth until he can join her in death so that he need not endure a single day without the knowledge of her close by.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   All of Heathcliff's actions sprung from his desire to be with Catherine.   When he was denied this, primarily because of his social standing and background, he sets about to ruin the lives of those who assume they are better than he because of their position in society.   Heathcliff cannot be categorized a villain but rather is dubbed Byronic Hero and to some extent, the victim of a spoiled manipulative brat.    Works Cited Damrosch, David, et al., ed.   The Longman Anthology of British Literature: Vol. B.   Compact ed.   New York: Longman - Addison Wesley Longman, 2000. The Restaurant that I’m Going to Own

It has always sounded extraordinary exiting to me to build my own restaurant. I can picture in my mind exactly how it would look and feel to my customers. I will be able to put my personality into my restaurant. I am thinking now about my restaurant’s interior, exterior, and, of course, menu. The interior of the restaurant that I am going to own its going to be big and spacious with an extra room for special events. It’s going to have nature decorations like plants, flowers, and fruits. It’s going to have nature colors like light brown, dark brown, green (gardenia green color). It’s going to have a light hardwood floor that will make the costumer feel very comfortable, the music that will be played its going to be relaxing instrumental music and live music on Saturday nights. It will have three different sizes of tables like 4 people tables, 6 people table and group tables ( 10 -12 chairs). The waiters are going to wear a comfortable uniform that will represent the restaurant colors. The exterior of my future restaurant it going to have a big and decorative sign that will be visible from long distance. It will be located in front of the beach and the walls are going to be made of wood and bamboo with the nature color of them, the roof will be made as a Hawaiian style. The principal door will be made of bamboo with a small glass window. Its decoration will represent an exotic Hawaiian style with a lot of leafs and flowers, and a beautiful fountain, and a big palm tree in front of the restaurant that will give to the customers the feeling of being in an island. It’s going to have a big parking lot for the customers and another one for the staff. We are going to offer a delicious and exquisite menu to our customers, offering Hawaiian food and exotic beverages. There will be a variety of Hawaiian food in our menu like Kalua Pork, Hawaiian BBQ Chicken, Saimin, Seafood, Salads, Mahi Mahi Burger, and much more. The prices will vary on the menu, but they will be affordable for everyone who wants to enjoy of our Hawaiian menu. Our main dishes will be the Kalua Pork, Hawaiian Chicken Teriyaki, steamed rice, vegetables, and salad. We will have some variety of dessert like ice cream, Lime Jello Cheesecake, Pies, and exotic fruits. Our menu will include free water and a delicious variety of appetizers that will make the customers feel happy to be in our restaurant. I have enjoyed preparing to construct my own restaurant. Beowulf describes, â€Å"scant regard for the dragon as a threat, no dread at all of its courage or strength, for he kept going often in the past† (2348-2351). Beowulf is caught up in his past glories blinding him from the actualization of how dangerous the dragon is. Being courageous means one knows their limits. Irena Sendler knew that she could not act alone in rescuing over 2,500 innocent children. Ambulance drivers would transport children under the floorboards w hile police officers would be bribed to allow traffic through an underground corridor. Unlike Beowulf Irena knew that she needed help to sneak past the giant Nazi regime to rescue thousands of Jewish children. is not caught up in being labeled as a hero for risking her life to save over 2,500 innocent children. Beowulf states, â€Å"I have wrestled the hilt from the enemies’ hand, avenged the evil done to the Danes; it is what was due† (1668-1670) Beowulf fights for justice and to avenge those who have done wrong. By fighting for your beliefs Beowulf displays that you cannot terrorize without repercussions. In 1943 the Nazi party commenced a liquidation of the Warsaw ghetto. Irena believes, â€Å"Every child saved with my help and the help of all the wonderful secret messengers, who today are no longer living, is the justification of my existence on this earth, and not a title to glory.† Irena did not want the title of glory she only fought for her beliefs in a non-violent manner. Unlike Beowulf she did not need to go out and avenge the Nazis for their vile acts towards humanity. A hero is brave and will put their lives on the line to protect mankind. Beowulf and a Irena are courageous no matter how daunting each of their tasks were. A hero stands up for the greater good of people when he witnesses mankind being threatened.
